Terms of Use

These Terms govern your use of the Magic Moments app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

• You must be at least 18 years old.
• You must provide accurate registration information, including a valid date of birth.
• You are responsible for safeguarding your account credentials.

2. Service Description

Magic Moments helps you meet people nearby, in real life. The Service includes:

• Magic Moment: continuous, location-based discovery of compatible people around you. You are visible to others only while discovery is on; your exact location is never shown.
• Whisper: a voice- or text-first exchange of short messages ("beats") that can build to a match, at which point profiles unlock.
• Matches & chat: a private conversation opens only on a mutual match and is time-limited (matches currently last 72 hours before becoming read-only).
• Events: browse and join events, including check-in at in-person events.
• Hearts, subscriptions & boosts: optional paid extras described in sections 7–8.

Features, limits and timings may evolve over time.

3. Accounts and Verification

• Registration requires email verification before your account becomes active.
• You may optionally verify your identity with a selfie to earn a verified badge.
• You are responsible for the content you post and the interactions you have.

4. Acceptable Use

You agree not to:

• Harass, threaten, impersonate, exploit, or abuse others.
• Post illegal, hateful, sexually exploitative, or violent content.
• Create fake profiles or misrepresent your identity or age.
• Attempt unauthorized access, reverse engineering, or disruption.
• Use the Service for fraud, spam, or unlawful activity.

5. User Content

• You retain ownership of your content (including photos, videos and voice recordings).
• You grant us a non-exclusive license to host, process, and display your content solely to operate and improve the Service.
• You are responsible for ensuring your content is lawful and does not infringe others' rights.

6. Safety and Moderation

• You can block and report users, messages, and whispers.
• Content or accounts may be restricted, suspended, or terminated; severe or repeated violations may be escalated to authorities.

How we moderate. Photos and videos you upload are checked automatically before they become visible, using Amazon Rekognition. Media identified as containing explicit nudity or sexual activity is rejected automatically and never shown to other users; borderline results are held for a person to review. Audio is not checked automatically. We also review content in response to user reports, and we keep records of the moderation decisions we make.

Child safety. Every photo and video is also checked against a database of known child sexual abuse imagery using Microsoft PhotoDNA. The check uses an irreversible fingerprint computed on our own servers, so the image itself is never sent to Microsoft. Where content matches, we preserve it as evidence, suspend the account and report to the competent authorities, and we may be unable to tell you the reason where doing so would obstruct a criminal investigation.

Reports and appeals. If you report something, we confirm receipt and tell you the outcome. If we act against your content or account, we tell you what we did, why, and whether the decision was automated. You can appeal within six months by emailing [email protected]; a person not involved in the original decision will review it. You may also use an out-of-court dispute settlement body or the courts, under Article 21 of the Digital Services Act. Our point of contact for users and authorities under Articles 11 and 12 is the same address.

7. Hearts and Purchases

• Hearts are a virtual, in-app currency with no monetary value. They cannot be exchanged for cash and are non-transferable.
• Hearts are purchased through Apple App Store or Google Play in-app purchases, at the prices shown in the app. New accounts may receive a small complimentary amount of hearts.
• Hearts are consumable and are spent immediately when you use a feature (for example an early Whisper unlock, a Spotlight message, or a Rewind). Except where required by law or by the applicable app-store policy, purchases and spent hearts are non-refundable.

8. Subscriptions and Boosts

• Subscriptions (such as Extended radius, Ghost mode, Custom Whisper location, Incognito read, Anonymous browse, and Who viewed you) are paid from your heart balance and renew automatically each month by deducting the applicable number of hearts. If your balance is insufficient at renewal, the subscription simply ends.
• You can cancel a subscription at any time; the benefit continues until the end of the paid period. Hearts already spent are not refunded. Some features may be provided free to certain users.
• These subscriptions are managed inside the app via your heart balance and are not Apple/Google auto-renewing subscriptions.
• Boosts (such as Spotlight and Rewind) are one-off actions paid in hearts and are consumed immediately.

9. Location and Real-World Interactions

• Location features require permission; the location shown to others is approximate and your exact position is never revealed.
• Real-world interactions are at your own risk. Use good judgment, meet in public where sensible, and follow local laws and safety best practices.

10. Termination

• You can stop using the Service and delete your account at any time.
• We may suspend or terminate accounts that violate these Terms or applicable laws.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of uninterrupted operation, accuracy, and fitness for a particular purpose. We do not guarantee that you will find a match or meet anyone.

12. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of data, profits, or goodwill.

13. Governing Law

These Terms are governed by the laws of Austria, excluding its conflict-of-law rules and any mandatory consumer-protection rights you have in your country of residence. The courts of Vienna, Austria have jurisdiction where permitted by law.

14. Platform Notices

• Apple and Google are not parties to these Terms and are not responsible for the Service.
• Any claims regarding the app should be directed to Magic Moments and not to Apple/Google, except where applicable platform rules provide otherwise.
